Private Beta Terms & Conditions

Plain English summary: You're getting early access to Sonde before it's public. We ask that you keep what you see confidential, give us honest feedback, and understand that the product is still being built — things may break. We won't charge you during the beta. Your data stays yours.

1 · Parties & Scope

These Terms & Conditions (“Terms”) govern access to the private beta version of Sonde, an early intelligence platform for agency new business development, operated by Christoph Kayser (“Sonde”, “we”, “us”) and made available at the invitation of Sonde to selected individuals and organisations (“Beta User”, “you”).

By accepting a beta invitation or accessing the Sonde platform in any form, you agree to be bound by these Terms. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation.

2 · Nature of the Beta

Sonde is currently in private beta. This means the platform is under active development and is not a finished, commercially released product. By participating, you acknowledge:

  • Features may be incomplete, modified, or removed without notice.
  • The platform may be unavailable, slow, or behave unexpectedly.
  • Data displayed (signals, scores, insights) may contain errors or be delayed.
  • The platform is not intended for mission-critical commercial use during the beta phase.

We will make reasonable efforts to keep the platform available and to notify you of significant changes, but we make no guarantees of uptime or continuity during the beta period.

3 · Access & Eligibility

Beta access is granted on an invitation-only basis and may be revoked at any time at our sole discretion. Access is personal and non-transferable. You may not share your login credentials or grant access to third parties.

Each invited organisation may designate one Account Owner — the individual responsible for the account, subscription, and user management — and one or more Users with operative access to the platform. The Account Owner is responsible for ensuring all users within their organisation comply with these Terms.

4 · Confidentiality

The Sonde platform, including its features, design, data outputs, underlying methodology, pricing models, and business plans, constitutes confidential information. You agree:

  • Not to disclose any aspect of the platform to third parties without our prior written consent.
  • Not to publish screenshots, recordings, descriptions, or reviews of the platform during the beta period.
  • Not to discuss platform features, data, or capabilities in public forums, social media, or press.
  • To use the same care to protect our confidential information as you use for your own, and no less than reasonable care.

This obligation does not apply to information that is or becomes publicly available through no fault of yours, or that you can demonstrate was independently developed or received from a third party without restriction.

5 · Feedback

We actively invite your feedback on the platform — bugs, usability issues, missing features, and general reactions. By providing feedback, you grant Sonde a perpetual, royalty-free, irrevocable licence to use that feedback in any way, including incorporating it into the product, without obligation or attribution to you.

Feedback does not create any intellectual property rights in the platform for you, and Sonde is under no obligation to act on any feedback provided.

6 · Fees & Beta Period

Access to Sonde during the private beta is provided free of charge. No payment is required and no subscription will be automatically initiated.

When Sonde transitions to a paid commercial service, we will notify beta users in advance and provide clear information about pricing, including any preferential rates or early-access terms offered to beta participants. You will not be charged without your explicit consent.

The beta period has no fixed end date. We may close the beta, transition to public access, or pause access at any time with reasonable notice.

7 · Your Data

Your data is yours. Any information you provide — agency profile, target company lists, user preferences — remains your property. We do not sell, license, or share your data with third parties.

We use your data solely to provide and improve the Sonde service. During the beta, we may review usage patterns and aggregated behaviour to understand how the platform is being used. This data is anonymised for analysis purposes.

On request, we will delete your account and associated data. If you do not request deletion and the platform transitions to a paid service, your data will be retained under the terms of the full service agreement presented at that time.

Sonde is built on infrastructure including Supabase (database), OpenAI (AI processing), and Serper (search indexing). By using the platform you acknowledge that your data may pass through these sub-processors, each of which operates under their own data protection terms.

8 · Acceptable Use

You agree to use Sonde only for its intended purpose — early intelligence for agency new business development. You may not:

  • Attempt to reverse-engineer, scrape, or extract data from the platform in bulk.
  • Use the platform to train competing machine learning models.
  • Use outputs to defame, harass, or harm individuals or organisations.
  • Attempt to circumvent security measures or gain unauthorised access to systems or data.
  • Resell or sublicense access to any third party.

9 · Intellectual Property

All rights in the Sonde platform — including software, design, methodology, brand, and content — remain exclusively with Sonde. These Terms do not transfer any ownership or licence rights to you beyond the right to use the platform during the beta period as described herein.

Signal data, AI-generated insights, and scoring outputs produced by Sonde are the intellectual property of Sonde. You may use these outputs for internal business development purposes only.

10 · Limitation of Liability

To the fullest extent permitted by applicable law, Sonde provides the platform during the beta period “as is” and without warranty of any kind. We expressly disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and accuracy of data.

Sonde shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including lost business opportunities or decisions made on the basis of platform outputs. Our total liability to you in connection with these Terms shall not exceed zero, as no fees have been paid during the beta.

Some jurisdictions do not permit the exclusion of implied warranties or limitation of liability, in which case the above exclusions apply to the fullest extent permitted.

11 · Termination

Either party may terminate access at any time. You may request removal of your account by writing to hello@sonde.one. Sonde may revoke your access immediately if you breach these Terms, particularly the confidentiality obligations.

On termination, your right to access the platform ceases immediately. Obligations of confidentiality, feedback licence, and acceptable use survive termination.

12 · Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.

These Terms are provided in English. In the event of a conflict between any translation and the English version, the English version prevails.

13 · Changes to These Terms

We may update these Terms at any time. If we make material changes, we will notify you by email with reasonable notice before the changes take effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms.
